Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your use of DiggerBox.com and any booking made through our website. By completing a purchase you agree to these Terms. DiggerBox is operated by Next Shelby Events LLC, a Tennessee limited liability company ("Company," "we," "us").

2. Booking & Payment

  • All bookings require full payment at the time of checkout via Stripe. Your date and time slot are not reserved until payment is confirmed.
  • You will receive a booking confirmation email immediately after payment, including your event details and a record of your signed liability waiver. Our team will follow up within 2 hours to confirm all logistics.
  • Prices displayed on our website are estimates. The final price is calculated server-side at checkout based on your selected date, package, and add-ons. The amount charged is the amount shown on the checkout page before you submit payment.
  • We reserve the right to cancel a booking and issue a full refund if we are unable to fulfill the service for any reason, including but not limited to equipment failure or crew unavailability.

3. Cancellations & Refunds

  • 7+ days before the event: Full refund, no questions asked.
  • 3–6 days before the event: 50% refund. The remaining 50% covers scheduling costs and equipment preparation.
  • Less than 48 hours before the event: No refund. The full amount is non-refundable.
  • To request a cancellation, email info@diggerbox.com with your booking details. Refunds are processed within 5–10 business days to your original payment method.
  • Rescheduling (not cancellation) is free if requested at least 72 hours in advance, subject to availability.

4. Weather Policy

We operate outdoors and weather-dependent situations are handled as follows:

  • Active lightning, tornado watch/warning, or sustained winds over 35 mph: We will reschedule at no charge. Safety is non-negotiable.
  • Rain: Light rain does not automatically cancel the event. We will work with you to assess conditions day-of. If we mutually agree conditions are unsafe or unsuitable, we reschedule at no charge.
  • Heat: Memphis summers are hot. We strongly recommend add-ons like the Pop-up Canopy and Misting Fan for summer events. Heat alone does not constitute grounds for a refund.
  • The final weather decision is made jointly between you and our crew no later than 2 hours before the scheduled start time.

5. Location Requirements

  • You are responsible for providing a flat, level area of at least 20 × 20 feet (400 sq ft) on grass, gravel, pavement, or packed dirt. Our trailer and equipment must be able to reach the setup area by vehicle.
  • The area must be free of sprinkler heads, buried utilities, and overhead obstructions exceeding 8 feet in the operating zone.
  • We serve Shelby County, TN (including Germantown, Bartlett, Collierville, Cordova, Lakeland, and East Memphis) and DeSoto County, MS (Southaven and Olive Branch). Bookings outside these areas are subject to a travel surcharge or may be declined at our discretion.
  • If our crew arrives and the location is unsuitable and cannot be resolved within 30 minutes, the booking will be treated as a cancellation under the less-than-48-hour policy (no refund).

6. Supervision & Safety

  • A DiggerBox attendant is present and in charge of equipment operation and safety at all times during the event.
  • A responsible adult (the booking party or their designee, age 21+) must be present at all times while children are using the equipment.
  • Children must follow all instructions given by the attendant. The attendant has authority to temporarily pause or end a child's participation for safety reasons without notice.
  • Equipment is intended for children up to approximately 12 years old. Adults are not permitted to operate RC equipment except during designated adult activity moments at the attendant's discretion.
  • Participants with serious medical conditions (heart conditions, epilepsy, etc.) should consult a physician before participation. You take responsibility for informing us of any relevant medical conditions prior to the event.

7. Limitation of Liability

To the maximum extent permitted by Tennessee law:

  • DiggerBox is not liable for injuries resulting from failure to follow our attendant's instructions, unsupervised use of equipment, or pre-existing medical conditions not disclosed to us.
  • Our total liability to you for any claim arising from a booking is limited to the amount you paid for that booking.
  • We are not liable for any indirect, incidental, or consequential damages, including but not limited to loss of enjoyment, third-party vendor costs, or property damage unrelated to our direct operations.

Nothing in these Terms limits liability for gross negligence, willful misconduct, or any liability that cannot be excluded under applicable law.

8. Photography & Media

We may take photos or video at events for use on our website and social media. If you do not want your event documented, notify us in writing at least 48 hours before the event. By default, booking constitutes consent to photography for marketing purposes, with no personally identifying information (names, addresses) associated publicly.

9. Governing Law & Disputes

These Terms are governed by the laws of the State of Tennessee. Any dispute arising from a booking will first be addressed through good-faith negotiation. If unresolved, disputes will be submitted to binding arbitration in Shelby County, Tennessee, under the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.

10. Changes to These Terms

We may update these Terms from time to time. The Terms in effect at the time of your booking govern that booking. We will not apply materially changed Terms retroactively to confirmed bookings.
